"Under the terms of her probation, Lindsay is required to 'obey all laws,'" Coombs said of Lohan, 26, who remains on informal probation for a case in which she was accused of stealing a necklace from a Los Angeles-area jeweler. "Even though the police are saying that no drugs or alcohol were involved, she was still arrested for hit and run, which is a misdemeanor crime. The prosecutors in Los Angeles will look at the evidence in the new case and decide whether or not to file a violation of probation hearing in front of the judge." Lohan was arrested and charged with leaving the scene of an accident in New York early Wednesday morning after she allegedly hit a man — known now to be chef Jose Rodriguez — in the knee with her car. "While some of the facts are still being gathered, it appears that this is much ado about nothing," Honig said in a statement released to Celebuzz. "We are confident this matter will be cleared up in the coming weeks and the claims being made against Lindsay will be proven untrue." Even so, Coombs — a former criminal trial prosecutor for the Los Angeles County District Attorney's Office – says that Lohan may have more legal woes ahead of her. "If the Judge finds that Lindsay has violated her probation, there are a variety of punishments available, such as extending the probation, adding more conditions to it, imposing more community service, and even sentencing Lindsay to more jail time," she said. lindsay lohan films 'scary movie 5' with charlie sheen 10 Photos » There's a chance, too, that Rodriguez may opt to file a civil suit against Lohan. "A civil suit is always possible, when the victim can prove actual damages– physical injury, emotional distress, etc." Coombs said.
